Terms of Use
These Terms of Use (also our end-user license agreement) are an agreement between you and TheKellyGShop ("we," "us") for using the TheKellyGShop app and website (the "Service"). By creating an account or using the Service, you agree to these terms. If you don't agree, please don't use the Service.
Using the Service
We grant you a personal, non-exclusive, non-transferable license to use the Service for your own reselling activity, subject to these terms. You must be at least 13 years old to use the Service. You agree not to misuse it — for example, by trying to access other people's accounts, interfering with the Service, overloading it with automated requests, copying or reverse-engineering it, or using it for anything unlawful.
Your account
You're responsible for keeping your sign-in details secure and for activity in your account. Tell us right away at support@thekellygshop.com if you think someone else has accessed it.
Price estimates and item identification
Item identifications, value estimates, sale-price ranges, and platform suggestions are estimates only. They're based on market information that changes constantly and may be incomplete or wrong. They are not appraisals, authentication, or financial advice, and we don't guarantee any item will sell or what it will sell for. You're responsible for your own buying and selling decisions.
Your content
You own the photos, notes, and records you add. You give us permission to store, process, and display that content only as needed to run the Service for you, including sending item photos to our identification provider. Please don't upload anything you don't have the right to use.
Subscriptions and free trials
Some features may require a paid subscription. New accounts may get a free trial; when it ends, a paid subscription is needed to keep using paid features. Subscriptions renew automatically at the price shown when you subscribe until you cancel. You can cancel anytime and keep access through the end of the current billing period. Except where required by law, payments are non-refundable. If prices change, we'll tell you before the change applies to you.
Changes and availability
We may update, change, or discontinue parts of the Service. We'll try to keep it available, but it may sometimes be interrupted. Keep your own copies of anything important — the app lets you export trips and sales as CSV files.
Ending your use
You can stop using the Service and delete your account at any time. We may suspend or close accounts that violate these terms or put the Service or other users at risk.
Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.
Limitation of liability
To the fullest extent permitted by law, TheKellyGShop will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim.
App stores
If you downloaded the app from Google Play or another app store, these terms are between you and us, not the store. The store's own terms also apply to your download.
Governing law
These terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law rules.
Changes to these terms
We may update these terms. If changes are significant, we'll update the date above and let you know in the app. Continuing to use the Service after a change means you accept the updated terms.
